Subdivision & Strata Certificates NSW

A Subdivision Certificate or Strata Certificate is the final certification step before a plan of subdivision or strata plan can be registered with NSW Land Registry Services. It confirms that the development has been completed in accordance with the relevant approval and all conditions of consent have been satisfied.

Who issues these certificates depends on your approval pathway, and getting that clarity early avoids delays at registration.

What is a Subdivision Certificate?

A Subdivision Certificate is issued under the Environmental Planning and Assessment Act 1979 and authorises the registration of a plan of subdivision. It confirms that all development consent conditions relating to the subdivision have been satisfied, and that the subdivision plan is consistent with the approved layout.

Who issues it depends on how your development was approved:

For developments approved via a Complying Development Certificate (CDC), a private certifier can issue the Subdivision Certificate. This is the pathway used for most dual occupancy and duplex subdivisions, townhouse and low-rise housing developments approved under the Low Rise Housing Diversity Code.

For developments approved via a Development Approval (DA), the Subdivision Certificate is issued by Council, not the private certifier. A private certifier’s role on a DA pathway project ends at the Subdivision Works Certificate stage.

Two types of subdivision:

Torrens Title

Creates separate parcels of land, each capable of being owned independently, including all structures within the lot boundaries.

Strata Plan

Divides a parcel of land into individual lots defined by three-dimensional space with shared common property.

What is a Strata Certificate?

A Strata Certificate is issued under the Strata Schemes Development Act 2015. It confirms that the strata plan is consistent with the development approval and that all relevant conditions have been satisfied, allowing the strata plan to be registered.

Unlike Subdivision Certificates, a private certifier can issue a Strata Certificate for both CDC-approved and DA-approved developments. Whether your project was approved by a private certifier or Council, Southwell Certifiers can issue the Strata Certificate.

Strata Certificates are required for residential flat buildings, townhouse developments, mixed-use strata schemes, and any development creating lots defined by airspace rather than land boundaries.

Subdivision Certificates (CDC pathway — private certifier):

  • Torrens title subdivision of townhouse and low-rise residential developments approved via CDC

The Certification Process

Step 1 — Engage your certifier before construction completes Engage Southwell Certifiers before works are finished. Early engagement allows us to confirm what documentation will be required and flag any outstanding consent conditions before lodgement.

Step 2 — Prepare your documentation package Compile the required documentation: final subdivision or strata plan prepared by a registered surveyor, compliance documentation addressing all conditions of consent, Water Authority compliance, and Construction Certificate drawings. We aim to respond within 1–2 business days of receiving a complete package.

Step 3 — Assessment We review all documentation against the relevant approval, conditions of consent, and legislative requirements. Any outstanding items are communicated clearly at this stage.

Step 4 — Issue of the Certificate Once all requirements are satisfied, the Subdivision or Strata Certificate is issued via the NSW Planning Portal. The plan can then be lodged with NSW Land Registry Services for registration.

Yes, but only for developments approved via a Complying Development Certificate (CDC) or State Significant Developments (SSD). For DA-approved subdivisions, the Subdivision Certificate is issued by Council. The CDC pathway is commonly used for duplex, dual occupancy, and low-rise housing developments under the Low Rise Housing Diversity Code.

Who issues a Subdivision Certificate for DA-approved developments?

Council issues the Subdivision Certificate for DA-approved developments. A private certifier’s involvement on a DA pathway typically covers the Subdivision Works Certificate stage, which authorises the engineering works, and any associated Compliance Certificates. Once works are complete, the Subdivision Certificate application is lodged with Council.

What is the difference between a Torrens title and strata subdivision?

What is the difference between a Subdivision Certificate and a Strata Certificate?

A Subdivision Certificate authorises registration of a plan of subdivision, creating separate Torrens title or community title lots. A Strata Certificate authorises registration of a strata plan, creating lots defined by airspace within a building.
