Subdivision certification services in Canterbury-Bankstown
Most subdivisions in the LGA fall under the Canterbury-Bankstown Local Environmental Plan 2023. The LEP carries forward two distinct planning overlays from the former Bankstown City and Canterbury City councils, mapped as Area 1 and Area 2 on the Clause Application Map. Lot size rules, frontage rules and subdivision standards differ between the two, this is the single most common reason CDC and DA pathways get knocked back at lodgement.
Canterbury-Bankstown is also one of the LGAs hit hardest by the NSW Low and Mid-Rise Housing Reform and the Bankstown-Sydenham Metro TOD SEPP. Stations at Bankstown, Punchbowl, Wiley Park, Lakemba, Belmore, Campsie, Canterbury and Hurlstone Park are converting to Metro, unlocking an estimated 15,000 to 20,000 R2 lots for dual occupancy and townhouse development. The category is moving fast and the LEP rules sit alongside the Code SEPP, Southwell Certiifers handles both.
Area 1 vs Area 2 — what they mean
The Clause Application Map splits the LGA into two distinct planning regimes:
- Area 1 broadly aligns to the former Bankstown City LGA. R2 dual occupancy rules are more flexible. Attached dual occ permitted on 500m² lots, detached on 700m². Subdivision down to 250m² (attached) or 350m² (detached).
- Area 2 broadly aligns to the former Canterbury City LGA. R2 dual occupancy needs 600m². Subdivision lots minimum 300m². Schedule 1 of the LEP also opens up dual occupancy in R3 and R4 zones under Area 2 (more on that below).
- Belmore and Lakemba Precinct and Punchbowl and Wiley Park Precinct sit inside Area 2 but get a carve-out: attached dual occ on 500m², subdivision at 250m². This is to encourage density around the Metro stations.
Always check the Clause Application Map for the specific lot before assuming which regime applies or contact us, we can check which areas your site belongs, and recommend this for every project at the eligibility stage.
Dual occupancy lot size and subdivision rules — quick table
Source: Canterbury-Bankstown LEP 2023, Clause 4.1A and Schedule 1 clauses 26 and 27.
| Location | Min lot for dual occ | Min lot on subdivision |
|---|---|---|
| R2, Area 1 — attached | 500m² | 250m² |
| R2, Area 1 — detached | 700m² | 350m² |
| R2, Area 2 | 600m² | 300m² |
| R2, Belmore and Lakemba Precinct — attached only | 500m² | 250m² |
| R2, Punchbowl and Wiley Park Precinct — attached only | 500m² | 250m² |
| R3, Area 2 (Schedule 1, cl. 26) | per LEP general rules | per LEP |
| R4, Area 2 (Schedule 1, cl. 27) | per LEP general rules | per LEP |
Important practical note: Schedule 1 cl. 26 and cl. 27 add bulk and scale controls (and a height limit in R4) on top of the standard zone rules. The right pathway – LEP DA or Code SEPP CDC, depends on the lot, the zone and the Area.
| Zone | Dual occupancy under the LEP land use table | Notes |
|---|---|---|
| R1 General Residential | Permitted with consent | LEP zone table |
| R2 Low Density Residential | Permitted with consent | Subject to Clause 4.1A lot size rules |
| R3 Medium Density Residential | Not in the standard land use table | Permitted with consent in Area 2 under Schedule 1 cl. 26, subject to the LEP's bulk and scale controls |
| R4 High Density Residential | Not in the standard land use table | Permitted with consent in Area 2 under Schedule 1 cl. 26, subject to the LEP's bulk and scale controls and an 8.5m height limit |
The Schedule 1 additional permitted use for R3 in Area 2 is often overlooked. Most owners and even some planners default to assuming dual occupancy is only an R1/R2 product in Canterbury-Bankstown. It isn’t. R3 in Area 2 is on the table, we confirm eligibility for each lot before quoting. See how the process runs on our duplex and dual occupancy subdivision page.
CDC Subdivision in Canterbury-Bankstown
The Low Rise Housing Diversity Code commenced in the Canterbury-Bankstown LGA on 1 July 2020. Since then, dual occupancies, terraces and manor houses that meet the Code can be approved as Complying Development. A CDC determination has a 20 business day legislated maximum. Southwell regularly issues faster on well-prepared applications.
Key Code SEPP minimums for dual occupancy: 450m² minimum lot, 8.5m height limit, 2 storeys. These are tighter than the LEP figures in some places and looser in others — the right pathway depends on the lot, the zone and the Area.
After construction is complete, Southwell issues the Subdivision Certificate so the surveyor can register the plan with NSW LRS and create separate titles.
