Area 1 vs Area 2 — what they mean

The Clause Application Map splits the LGA into two distinct planning regimes:

  • Area 1 broadly aligns to the former Bankstown City LGA. R2 dual occupancy rules are more flexible. Attached dual occ permitted on 500m² lots, detached on 700m². Subdivision down to 250m² (attached) or 350m² (detached).
  • Area 2 broadly aligns to the former Canterbury City LGA. R2 dual occupancy needs 600m². Subdivision lots minimum 300m². Schedule 1 of the LEP also opens up dual occupancy in R3 and R4 zones under Area 2 (more on that below).
  • Belmore and Lakemba Precinct and Punchbowl and Wiley Park Precinct sit inside Area 2 but get a carve-out: attached dual occ on 500m², subdivision at 250m². This is to encourage density around the Metro stations.

Important practical note: Schedule 1 cl. 26 and cl. 27 add bulk and scale controls (and a height limit in R4) on top of the standard zone rules. The right pathway – LEP DA or Code SEPP CDC, depends on the lot, the zone and the Area.

CDC Subdivision in Canterbury-Bankstown

The Low Rise Housing Diversity Code commenced in the Canterbury-Bankstown LGA on 1 July 2020. Since then, dual occupancies, terraces and manor houses that meet the Code can be approved as Complying Development. A CDC determination has a 20 business day legislated maximum.
